GENERAL TERMS AND CONDITIONS OF SALE, REPAIR AND APPRAISAL
L’ARTISAN DU TEMPS SRL
Version dated 1 January 2026
L’Artisan du Temps is a company specialising in collectible timepieces, the purchase and sale of vintage and contemporary watches, their servicing, repair, restoration and appraisal.
Since 2004, the company has placed its watchmaking expertise at the service of collectors and watch enthusiasts.
These General Terms and Conditions define the respective commitments of L’Artisan du Temps and its customers. They take into account the particular nature of collectible objects, their sometimes complex histories and the continuous evolution of horological knowledge.
They apply in accordance with Belgian legislation and the mandatory rights afforded to consumers.
CHAPTER I — GENERAL PROVISIONS
ARTICLE 1 — COMPANY IDENTIFICATION
These General Terms and Conditions are issued by:
L’Artisan du Temps SRL

ARTICLE 2 — SCOPE OF APPLICATION
These General Terms and Conditions govern:
-
The sale of antique, vintage, modern and contemporary watches.
-
The sale of horological objects, accessories and collectibles.
-
Servicing, repair and restoration services.
-
Appraisals, valuations, technical examinations and descriptive certificates.
-
Services associated with these activities.
They supplement invoices, order forms, quotations, certificates, appraisal reports and contractual documents provided to customers.
Any specific terms expressly agreed between the parties shall prevail in the event of a conflict with these provisions.
Mandatory legal provisions applicable to consumers shall remain fully applicable.
Transactions concluded between professionals shall be subject to the provisions specifically applicable to them.
ARTICLE 3 — NATURE OF COLLECTIBLE OBJECTS
Watches and collectible objects offered by L’Artisan du Temps are sold in their condition and configuration at the time of sale, as presented and described to the buyer.
Given their age, they may have undergone various servicing, repair, restoration or component replacement procedures.
A vintage watch may contain original parts, service replacement parts, compatible period components, restored elements or components replaced during previous interventions.
The overall authenticity of a watch, the individual originality of each of its components, its state of preservation and its conformity with its original factory configuration are distinct characteristics.
The presence of replaced, restored or compatible components does not necessarily compromise the authenticity of the watch as a whole.
Unless a specific commitment has been expressly agreed, the sale of a vintage watch does not constitute exhaustive certification of the origin, manufacturing period or individual originality of each of its components.
L’Artisan du Temps undertakes to disclose any significant characteristics of which it is aware that may influence the purchasing decision, in accordance with its legal obligations.
CHAPTER II — SALE OF WATCHES AND COLLECTIBLE OBJECTS
ARTICLE 4 — EVOLUTION OF KNOWLEDGE, RESTORATIONS AND HISTORICAL AUTHENTICITY
Vintage and collectible watches may have undergone various servicing, repair or restoration procedures throughout their existence, including the replacement or modification of certain components.
Assessments made by L’Artisan du Temps concerning the authenticity, originality, dating, composition and historical consistency of an object are made in good faith, based on horological knowledge, examination methods and information reasonably available at the time of sale or appraisal.
As the complete history of an antique object cannot always be reconstructed with certainty, certain characteristics or previous interventions may remain unknown, even following a thorough professional examination.
Historical, technical and documentary knowledge continues to evolve. Subsequent research, new analytical methods or access to previously unavailable archives may lead to an assessment differing from the original conclusions.
A subsequent evolution in knowledge or a difference of opinion between experts or watch manufacturers does not, in itself, constitute proof of professional negligence or a lack of conformity justifying cancellation of the sale.
Assessments issued by watch manufacturers are considered according to their technical scope, the evidence on which they are based and the criteria applied. They may be subject to independent review or examination involving both parties.
The discovery of a component previously replaced, restored or historically different does not automatically justify termination of the sale. Any consequences shall be assessed in light of the contractual description, the material significance of the characteristic identified, the information available at the time of the transaction and applicable law.
These provisions do not affect the buyer’s statutory rights in cases of non-conformity, hidden defects or established breaches of obligation by L’Artisan du Temps.
ARTICLE 5 — HISTORICAL DOCUMENTS, CERTIFICATES AND ACCESSORIES
Watches may be accompanied by boxes, certificates, warranty documents, invoices, archive extracts and other historical accessories.
Their presence is indicated in the commercial description according to the information available.
Unless specifically agreed otherwise, the presence of a period document or accessory does not constitute exhaustive certification of its physical authenticity, date of creation or history.
Certain historical documents may have been altered, reproduced or falsified in ways that are particularly difficult to detect using reasonably available examination methods.
Assessments made by L’Artisan du Temps concerning these documents are based on the knowledge, observations and information available at the time of examination.
Any documentary irregularity discovered subsequently shall be assessed according to its significance, the characteristics contractually guaranteed and the applicable legal provisions.
L’Artisan du Temps remains obliged to disclose any known significant irregularity and to comply with its legal obligations.
ARTICLE 6 — DESCRIPTION, EXAMINATION AND ACCEPTANCE OF OBJECTS
L’Artisan du Temps presents objects according to the information available at the time of sale.
Commercial descriptions, photographs, references, serial numbers, period indications and any accompanying documents enable buyers to assess the characteristics of the object offered.
When purchasing in-store, buyers have the opportunity to examine the object, request further information and review the available documentation before concluding the sale.
Buyers acknowledge that antique objects may exhibit manufacturing characteristics, signs of servicing, wear or restoration associated with their history.
Where particular known characteristics are expressly described and validly accepted, they form part of the contractual characteristics of the object.
Where a characteristic deviates from the legally applicable objective conformity requirements, the consumer must be specifically informed and must expressly and separately accept that deviation, in accordance with the law.
The opportunity to examine an object does not constitute a general waiver of statutory warranties.
ARTICLE 7 — AUTHENTICITY AND MANUFACTURERS’ OPINIONS
L’Artisan du Temps examines watches offered for sale using its professional expertise and appropriate technical resources.
Watch manufacturers may apply their own criteria regarding authenticity, historical conformity, restoration and acceptance for after-sales servicing.
These criteria may differ from the practices and assessments of other professionals or independent experts.
A manufacturer’s refusal to service a watch, or its expression of a differing opinion concerning one of its components, does not automatically establish that the object as a whole materially fails to conform to the sales contract.
An unfavourable assessment issued by a manufacturer shall be examined according to its technical reasoning, scope and specific findings.
Any disagreements may be subject to further examination or independent assessment involving both parties.
Where established facts demonstrate counterfeiting, a material lack of conformity or a legally relevant breach of obligation, the buyer’s statutory remedies shall remain applicable.
ARTICLE 8 — PRICES, ORDERS AND RESERVATIONS
Sale prices are those indicated or confirmed at the time of the transaction, including all applicable taxes for consumers.
Any delivery charges or additional costs shall be communicated before the order is concluded.
A reservation may be subject to payment of a deposit under expressly agreed conditions.
Once a binding sale has been concluded, both parties are required to fulfil their contractual obligations, subject to statutory grounds for termination, cancellation or withdrawal.
The mere payment of a sum does not, in itself, determine the legal nature of the commitment. This depends on the terms of the transaction.
L’Artisan du Temps may refuse an offer to purchase before a binding sale has been concluded, in accordance with applicable legal provisions.
ARTICLE 9 — PAYMENT AND DELIVERY
Accepted payment methods are those offered at the time of the transaction.
Unless otherwise agreed, full payment is required before the object is handed over or dispatched.
L’Artisan du Temps may retain ownership of the object sold until the purchase price has been paid in full, under the conditions permitted by law.
Deliveries may be made within Belgium or internationally according to the agreed arrangements.
Shipped objects are appropriately packaged and transported using a method selected according to their nature and value.
Delivery charges, estimated times, territorial restrictions and delivery arrangements are communicated before the sale is concluded.
For consumer sales, the transfer of risk takes place in accordance with statutory provisions, particularly when the consumer or a third party designated by the consumer takes physical possession of the goods, subject to legally established exceptions.
Any customs duties, import taxes and formalities associated with international delivery shall be specified in the conditions communicated to the customer, insofar as they are applicable and known.
ARTICLE 10 — THREE-YEAR COMMERCIAL WARRANTY
All watches sold by L’Artisan du Temps benefit from a free three-year commercial warranty commencing on the date of delivery.
This warranty covers the general proper functioning of the watch and its various functions, including:
-
The movement and its operation.
-
Manual or automatic winding.
-
Time setting and the crown mechanism.
-
Date display and calendar functions.
-
Chronograph functions.
-
Any other functions and complications.
The warranty covers failures arising under normal operating conditions, subject to the provisions of this Article.
It does not cover damage directly caused after the sale by impact, dropping, improper handling, inappropriate use, unauthorised third-party intervention or water ingress attributable to the user.
Normal cosmetic wear and accidental damage unrelated to a covered functional defect are excluded from this commercial warranty.
The functional warranty does not constitute certification of the absolute historical originality of every component or document accompanying the watch.
L’Artisan du Temps carries out the initial technical examination of watches submitted under warranty and determines whether the claim is covered based on objective technical findings, subject to statutory rules of evidence and consumer remedies.
Where a failure is covered by the commercial warranty, L’Artisan du Temps shall arrange, free of charge, the repair of the covered elements, including the necessary parts and labour. If repair is impossible, an appropriate solution shall be sought in accordance with contractual commitments and applicable legal provisions.
To request warranty service, the buyer must contact L’Artisan du Temps with proof of purchase and make the watch available for examination according to the agreed arrangements.
The commercial warranty applies to watches sold by L’Artisan du Temps regardless of the buyer’s country of residence. Warranty services are organised through L’Artisan du Temps in Belgium, without prejudice to statutory rules concerning associated costs.
The warranty is provided by L’Artisan du Temps SRL, Chaussée de Waterloo 758, 1180 Uccle, Belgium, contactable at info@artisandutemps.com.
This commercial warranty is additional to the statutory guarantee of conformity. It does not in any way limit consumers’ statutory rights, including their right to remedies free of charge against the seller in the event of a lack of conformity.
ARTICLE 11 — STATUTORY GUARANTEE OF CONFORMITY
Sales concluded with consumers benefit from the statutory guarantee of conformity provided for under Articles 1649bis et seq. of the former Belgian Civil Code.
The statutory guarantee is, in principle, valid for two years from delivery of the goods.
For second-hand goods, a reduction of this period is applicable only where it has been expressly provided for and brought to the consumer’s attention in accordance with the law, and may not be less than one year.
The three-year commercial warranty granted by L’Artisan du Temps remains applicable under its own terms, independently of any such statutory reduction.
In the event of an established lack of conformity, consumers have access to the remedies provided by law, including repair or replacement where possible and proportionate.
A price reduction or termination of the sale may be requested in the circumstances provided for by law.
A minor defect does not justify termination of the sale under the statutory guarantee.
No provision of these General Terms and Conditions deprives consumers of their statutory rights.
ARTICLE 12 — WATER RESISTANCE
A watch’s water resistance depends on its design, condition, seals, case and conditions of use.
Water resistance may change over time due to wear, impacts or interventions carried out on the watch.
The presence of a historical water-resistance marking on a vintage watch does not necessarily guarantee its current resistance to water.
Where a water-resistance test is performed, the results reflect the condition of the watch and the test conditions at the time of examination.
Any significant recommendations and restrictions concerning use shall be communicated to the customer.
Damage resulting from use contrary to the precautions communicated is not covered by the commercial warranty where attributable to such use.
L’Artisan du Temps remains subject to its statutory obligations where a water-resistance defect constitutes a lack of conformity or results from negligent intervention.
ARTICLE 13 — TECHNICAL DIAGNOSIS AND WARRANTY CLAIMS
L’Artisan du Temps performs or arranges the initial diagnosis of watches submitted under warranty.
The examination may include the operation of the movement, the condition of components and evidence of impact, dropping, water ingress or third-party intervention.
Findings are established by L’Artisan du Temps or by specialised professionals appointed by the company.
Coverage under the commercial warranty is determined according to the results of this examination and the applicable contractual conditions.
Any refusal of warranty coverage must be based on objective technical evidence and may be explained to the customer.
Initial conclusions may be reconsidered where relevant contradictory evidence is presented.
Statutory rules concerning evidence and consumer rights remain applicable.
ARTICLE 14 — DISPUTES CONCERNING A SALE OR AUTHENTICITY
Any dispute concerning the authenticity, originality, condition, composition or conformity of an object sold by L’Artisan du Temps shall be subject to a review of the commercial and technical records.
Customers are invited to provide documents, reports or findings supporting their claim.
L’Artisan du Temps may request that the object be presented for additional verification, under the conditions provided by law.
Where serious conflicting opinions exist, an independent or jointly conducted expert examination may be proposed.
The discovery of a replaced, restored or historically different component does not automatically entitle the buyer to a full refund.
Any consequences depend, in particular, on the contractual description, the significance of the irregularity, the characteristics guaranteed and the applicable legal provisions.
Where possible, disputed components and evidence should be preserved during the verification process, subject to statutory obligations or essential protective measures.
The liability of L’Artisan du Temps shall be assessed in accordance with applicable law.
ARTICLE 15 — RETURNS AND RIGHT OF WITHDRAWAL
Sales definitively concluded in-store are not subject to a general right of withdrawal due solely to a change of mind, unless otherwise provided by law or a specific commercial commitment.
For distance sales contracts concluded with consumers, the consumer is, in principle, entitled to a statutory withdrawal period of 14 calendar days from receipt of the goods, subject to legal exceptions.
This right also applies, in principle, to second-hand watches and collectible objects sold at a distance.
Consumers may exercise this right without providing a reason by communicating an unequivocal statement to L’Artisan du Temps, particularly by email to info@artisandutemps.com or by using the withdrawal form provided at the end of these General Terms and Conditions.
Where required by regulations applicable to the sales interface used, an online withdrawal facility shall also be made available.
Consumers must return or hand back the goods within 14 days of communicating their decision to withdraw.
Direct return costs shall be borne by the consumer where they were properly informed of this before the contract was concluded, unless otherwise required by law or voluntarily covered by L’Artisan du Temps.
Given the potentially significant value of the objects, customers are advised to arrange their return using appropriate secure transportation. This recommendation does not constitute an additional condition for exercising the statutory right of withdrawal.
Consumers may be held liable for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the goods, under the conditions provided by law.
L’Artisan du Temps shall refund all amounts legally due, including the original standard delivery charges where these must be refunded, within a maximum of 14 days following notification of withdrawal.
The refund may be withheld until the goods have been recovered or evidence of their return shipment has been provided, in accordance with the law.
Refunds shall be made using the original payment method unless the consumer expressly agrees to another method without incurring additional charges.
Statutory exceptions to the right of withdrawal, particularly those relating to certain clearly personalised goods, apply only where their conditions are actually met.
Specific rules applicable to off-premises contracts and service agreements remain applicable.
CHAPTER III — REPAIRS, SERVICING AND RESTORATION
ARTICLE 16 — RECEIPT AND EXAMINATION OF OBJECTS
L’Artisan du Temps provides servicing, repair, overhaul, restoration and refurbishment services for watches and horological objects.
Upon receipt of an object, a service record is created identifying its recognisable characteristics and any accessories entrusted to the company.
The initial examination may be limited and does not necessarily allow all internal defects, previous damage, earlier interventions or modifications to be detected.
Certain irregularities may become apparent only when the object is opened, dismantled or examined in greater detail.
Photographs and technical observations may be taken and retained in the service record.
ARTICLE 17 — QUOTATIONS AND AUTHORISATION OF WORK
Interventions are carried out in accordance with quotations or services accepted by the customer.
Acceptance of a quotation authorises L’Artisan du Temps to perform or arrange the operations necessary to complete the agreed work.
Where additional defects are discovered, a supplementary quotation may be proposed.
Any intervention involving additional charges not included in the original quotation requires the customer’s prior consent, unless otherwise provided by specific legislation.
L’Artisan du Temps may refuse or discontinue an intervention where, in its reasoned technical assessment, the requested work would not achieve an appropriate professional result.
Previously accepted diagnostic and examination fees remain payable where those services have been performed, even if the repair is ultimately not carried out.
For service contracts concluded at a distance or off-premises, any applicable withdrawal rights and conditions governing the early commencement of services are subject to the relevant legislation.
ARTICLE 18 — REPLACEMENT AND RESTORATION OF COMPONENTS
Repairs and restorations may require the replacement, refurbishment, adaptation or manufacture of certain components.
Depending on the nature of the object and the availability of parts, interventions may require original parts, service replacement parts, compatible vintage components or specially manufactured parts.
L’Artisan du Temps determines the technical solutions it considers appropriate for the agreed work, taking into account the characteristics of the object, its historical significance and contractual obligations.
Interventions likely to significantly alter the appearance, historical originality or collectible value of the object shall be brought to the customer’s attention before being carried out, where such interventions have been identified and planned.
L’Artisan du Temps may refuse a partial repair where it cannot reasonably ensure the desired reliability or technical safety.
Replaced parts may be returned to the customer upon prior request, where available and where their return is compatible with applicable supply or exchange conditions.
ARTICLE 19 — PARTICULAR CHARACTERISTICS OF VINTAGE WATCHES
Vintage watches may have technical characteristics, operating tolerances and resistance levels that differ from those of contemporary watches.
Certain parts may be weakened, worn, unavailable or may have undergone successive restorations.
A repair may require technical adaptations or the manufacture of specific components.
Interventions are determined according to the knowledge and technical resources reasonably available at the time they are carried out.
L’Artisan du Temps cannot guarantee the permanent availability of all vintage spare parts.
Significant technical limitations identified shall be communicated to the customer where they may affect the service provided.
ARTICLE 20 — SERVICE TIMES
Repair and restoration times take into account the complexity of the work, the availability of parts and any involvement of specialised professionals or watch manufacturers.
Agreed deadlines shall be respected in accordance with applicable legal provisions.
Estimated completion times may be adjusted where unforeseen technical circumstances or supply difficulties arise.
In the event of a significant change, L’Artisan du Temps shall inform the customer and seek an appropriate solution.
ARTICLE 21 — WARRANTY ON REPAIRS
Repairs and servicing performed by L’Artisan du Temps benefit from a three-year commercial warranty covering the work carried out and the components supplied as part of that work.
This warranty commences when the repaired object is returned to the customer.
It covers failures attributable to the performance of the agreed work or to components supplied as part of that work, under normal conditions of use.
The scope of the warranty depends on the nature of the intervention performed.
A repair limited to a particular component does not necessarily constitute a complete overhaul of the movement or a full refurbishment of the watch.
The warranty does not cover damage directly caused after the intervention by impact, dropping, improper use, unauthorised third-party intervention or water ingress attributable to the user.
L’Artisan du Temps performs or arranges the technical examinations necessary to assess warranty claims.
Any failure covered by the commercial warranty shall result in corrective work free of charge for the relevant labour and components. Where such corrective work is impossible, the parties shall seek a solution consistent with their respective rights and obligations.
L’Artisan du Temps remains fully subject to its statutory liabilities concerning the proper performance of services and any damage attributable to negligent intervention.
The warranty is provided by L’Artisan du Temps SRL and may be claimed by contacting info@artisandutemps.com and providing documentation confirming the work performed.
ARTICLE 22 — WATER RESISTANCE FOLLOWING INTERVENTION
The performance of an overhaul, servicing or repair does not automatically constitute certification of water resistance.
Where a water-resistance test is performed, its result reflects the condition of the object and the test conditions at the time of examination.
L’Artisan du Temps may recommend certain restrictions on use depending on the age, condition or technical characteristics of the watch.
Damage resulting from use contrary to the precautions communicated may be excluded from the commercial warranty where attributable to such use.
Statutory obligations relating to the work performed remain applicable.
ARTICLE 23 — STORAGE AND RETURN OF OBJECTS
Objects entrusted for repair, restoration or appraisal are stored with the care and precautions reasonably expected of a professional watchmaking specialist.
They are covered by L’Artisan du Temps’ insurance according to the coverage, limits and exclusions of the policy taken out.
The company’s liability in the event of loss, theft or damage is determined in accordance with applicable legislation.
Objects shall be returned to their owner or a duly authorised representative, following identity verification where necessary.
Payment for services shall be made according to the agreed terms.
Any right of retention over an object shall be exercised exclusively under the conditions permitted by Belgian law.
ARTICLE 24 — UNCOLLECTED OBJECTS
Following completion of a repair, restoration or appraisal, the customer shall be informed that the object is available for collection.
The customer is invited to arrange collection within a reasonable period.
If the object remains uncollected, L’Artisan du Temps may send reminders using the contact details provided by the customer.
Objects shall continue to be stored in accordance with statutory obligations.
Failure to collect an object does not automatically constitute abandonment of ownership.
Any additional storage fees may be charged only where they have been validly agreed or are legally payable.
CHAPTER IV — APPRAISALS, VALUATIONS AND CERTIFICATES
ARTICLE 25 — NATURE AND SCOPE OF APPRAISALS
L’Artisan du Temps provides horological appraisals, valuations, technical examinations, authentication assessments and descriptive certificates according to the assignment entrusted to it.
An appraisal constitutes a reasoned professional opinion based on observations made, available documents, horological knowledge and the examination methods selected.
Its scope depends on the agreed assignment.
An appraisal may concern, in particular, the identification of a watch, its period, condition, components, historical consistency, apparent authenticity or commercial value.
A descriptive certificate does not necessarily constitute exhaustive authentication of all components of the object.
Conclusions are limited to the elements examined and the verifications actually included in the assignment.
ARTICLE 26 — METHODOLOGY AND LIMITATIONS OF EXAMINATIONS
Examinations are carried out using the technical and documentary resources considered appropriate for the assignment entrusted.
Unless otherwise agreed, an appraisal does not necessarily involve complete dismantling of a movement, metallurgical analysis, destructive testing, exhaustive consultation of archives or detailed physical verification of every component.
Certain previous repairs, restorations, substitutions or modifications may remain undetectable without additional examinations.
The customer undertakes to provide any information and documents in their possession that may influence the appraisal.
Significant examination limitations shall be indicated where they affect the scope of the conclusions.
L’Artisan du Temps may propose additional investigations where deemed necessary, subject to the customer’s agreement regarding their nature and cost.
ARTICLE 27 — INDEPENDENCE AND DIFFERENCES OF EXPERT OPINION
Appraisals performed by L’Artisan du Temps are based on independent professional assessments founded on the knowledge, observations and documentary evidence available on the date of the report.
Conclusions may differ from those of other experts, collectors, auction houses or watch manufacturers.
Such differences may result, in particular, from variations in methodology, historical criteria, access to archives, restoration policies or technical interpretations.
Watch manufacturers may apply their own criteria and policies in connection with their after-sales services.
The existence of a conflicting opinion does not automatically establish professional negligence or an error in the original appraisal.
Significant new or contradictory evidence may be subject to reassessment and, where necessary, an independent or jointly conducted expert examination.
Any statutory liabilities arising from professional negligence remain applicable.
ARTICLE 28 — AUTHENTICITY, ORIGINALITY AND HISTORICAL DOCUMENTS
In the field of collectible watches, an assessment of the overall authenticity of a watch must be distinguished from an assessment of the originality and period of each of its components.
An authentic watch may have undergone interventions, restorations or component replacements during its lifetime.
Certain parts may have been manufactured during the same period as the watch without necessarily having originally been intended for its particular model or manufacturer.
Assessment of their historical consistency depends on the available information and technical evidence.
Historical documents, including certificates, invoices, warranties, archive extracts and period attestations, may contain falsifications or alterations that are particularly difficult to detect.
Unless a specific assignment and appropriate verification procedures have been agreed, an appraisal does not constitute an absolute guarantee of the physical authenticity of every document or component accompanying a watch.
Assessments are expressed with any reservations justified by the elements examined and the limitations of the assignment.
ARTICLE 29 — EVOLUTION OF APPRAISALS AND NEW KNOWLEDGE
Horological, historical and technical knowledge evolves over time.
Previously unavailable archives, subsequent research, new analytical methods or new discoveries may lead to certain conclusions being reassessed.
Appraisal reports are prepared using information reasonably available on the date they are issued.
A subsequent reassessment does not automatically demonstrate that the original assessment was negligent.
Any dispute shall be assessed in light of the assignment entrusted, the knowledge available on the date of the report, the examination methods employed and the applicable professional obligations.
The conclusions of L’Artisan du Temps are not irrevocable and may be reconsidered on the basis of new technical evidence.
ARTICLE 30 — ESTIMATES AND COMMERCIAL VALUES
Values communicated as part of an appraisal constitute professional estimates established on a specific date.
They may take into account rarity, condition, originality, provenance, demand and available market data.
An estimate does not constitute a guarantee of a future sale price or auction result.
Market fluctuations and information discovered subsequently may affect the value of an object.
ARTICLE 31 — FEES AND DISPUTES CONCERNING REPORTS
Appraisal fees cover the examinations, research, observations and analytical work performed within the scope of the agreed assignment.
They do not depend on whether the conclusions are favourable or unfavourable to the customer.
The mere existence of a differing appraisal does not automatically entitle the customer to a refund of the fees.
Any reasoned objection may be submitted to L’Artisan du Temps together with the relevant technical documentation.
The customer’s statutory rights in the event of negligent or non-conforming services remain applicable.
Reports must be interpreted in their entirety, taking into account their date, purpose and any reservations expressed.
CHAPTER V — COMMON PROVISIONS
ARTICLE 32 — COMPLAINTS AND INDEPENDENT EXAMINATIONS
Any complaint relating to a sale, repair, restoration or appraisal may be submitted to L’Artisan du Temps.
The company shall review the relevant records and may request the documents and technical evidence necessary for its assessment.
Where a significant technical disagreement exists, the parties may agree to an independent or jointly conducted expert examination.
The technical findings of L’Artisan du Temps constitute its initial professional position, without prejudice to the customer’s right to challenge them and pursue the remedies provided by law.
The parties undertake to cooperate in good faith to facilitate examination of the disputed matters.
ARTICLE 33 — LIABILITY
L’Artisan du Temps conducts its activities with the skills, diligence and precautions reasonably expected of a professional specialising in watchmaking.
Its liability is determined according to the nature of the contract, the services agreed, the circumstances and the applicable legal provisions.
Subsequent developments in knowledge, the emergence of new information or the expression of a conflicting opinion do not automatically establish negligence.
No provision of these General Terms and Conditions is intended to exclude mandatory statutory liability, remove consumers’ legal remedies or exempt L’Artisan du Temps from the consequences of any fault for which it is legally responsible.
ARTICLE 34 — PERSONAL DATA
L’Artisan du Temps collects the personal data necessary to manage its sales, orders, repairs, appraisals, payments and legal obligations.
Such data is processed in accordance with applicable data protection regulations.
Information concerning the purposes of processing, retention periods and the rights of data subjects is provided in the privacy policy available on the L’Artisan du Temps website.
ARTICLE 35 — COMPLAINTS, APPLICABLE LAW AND COMPETENT COURTS
These General Terms and Conditions and the contracts to which they apply are governed by Belgian law, without prejudice to any applicable mandatory provisions.
In the event of a dispute, the parties shall endeavour to reach an amicable settlement.
Failing agreement, the competent courts of the judicial district of Brussels shall have exclusive jurisdiction, to the extent permitted by applicable legislation.
This jurisdiction clause does not affect consumers’ mandatory rights, particularly the statutory rules governing judicial jurisdiction applicable to them.
Consumers may also contact the Belgian Consumer Mediation Service after first raising the matter with L’Artisan du Temps, under the conditions established by that service.
